CUonline Terms & Conditions

1. General, Other Mandates

1.1 These Terms & Conditions govern the Member's use of CUonline Services.

1.2 These Terms supplement Other Mandates and override in case of conflict.

1.3 Applying for and using CUonline means the Member agrees to these Terms.

2. Account Control

2.1 CUonline has transaction limits:

  • Transfer Within Own Account – KYD 250,000 per transaction, KYD 500,000 per day

2.2 Members must notify Credit Union of access changes in writing.

2.3 Members may be subject to regulatory reporting obligations.

3. Member’s Liability for Member Instructions

3.1 Member releases the Credit Union from liability for actions taken per Instructions.

3.2 Credit Union not liable for delays/errors caused by Member or external issues.

3.3 Liability only for direct losses caused by intentional misconduct.

3.4 No liability for consequential or indirect losses.

3.5 No liability for third-party software or access services.

4. Security Procedures and Member Instructions

4.1 Members are responsible for Password confidentiality and authorize Credit Union to act on Instructions.

4.2 Members must follow Credit Union’s security recommendations and regularly review practices.

4.3 Member confirms that Security Procedures are adequate when combined with internal practices.

4.4 Passwords must be secure, act as digital signatures, and may be changed by the Member.

4.5 Unauthorised access must be reported immediately.

4.6 Devices used for access must be virus and spyware free.

4.7 Members are responsible for browser security and updates.

5. Banking Services Available and Account Control

5.1 Available services: Transfers, Term Deposits, Third-party Transfers, Standing Orders, Loan Payments.

5.2 Member authorizes Credit Union to process Instructions without further approval.

5.3–5.5 Transfers and payments may be processed automatically or same-day.

5.6 Instructions should be submitted 3 days in advance to ensure timely processing.

5.7 Credit Union is not liable for delays caused by external systems.

5.8–5.9 Instructions may be rejected due to policy non-compliance or insufficient funds.

5.10 Credit Union may rely on account numbers alone.

5.11.2–5.14 Conditions under which Instructions may be refused (non-compliance, risk, disputes, etc.).

6. Electronic Statements

6.1 Members may opt for electronic statements in lieu of paper delivery.

6.2 Paper statements can be requested for a fee.

7. Hardware and Software Requirements

7.1 Member agrees to have access to required hardware/software per CUonline Guides.

7.2 Member agrees to upgrade systems or terminate CUonline if delivery methods change.

8. Fees

8.1 Member agrees to pay fees as per Credit Union's schedule, subject to change.

8.2 Member is responsible for internet or telephone provider fees.

9. Release and Indemnity

9.1 Member releases and indemnifies the Credit Union for losses related to CUonline use or breaches.

9.2 Member indemnifies the Credit Union for actions taken based on Instructions or non-compliance.

10. Termination

10.1 Credit Union may terminate or reinstate access at any time. Reinstated access is subject to current Terms.

11. Service Interruption

11.1 CUonline may be unavailable during maintenance or issues beyond Credit Union's control.

12. Force Majeure

12.1 Neither party is liable for delays caused by events beyond reasonable control (e.g., disaster, war).

13. Intellectual Property

13.1 All content belongs to or is licensed by the Credit Union. Reuse requires written permission.

13.2 Tools on the website are subject to separate terms and disclaimers.

14. Changes to Terms & Conditions

14.1 Credit Union may amend Terms at any time. Notice will be provided via website, Message Center, or email.

14.2 Continued use indicates acceptance of changes.

15. Interpretation

15.1 Singular includes plural and vice versa. "Persons" includes companies and associations. Times are in EST (Cayman Islands).

16. Assignment

16.1 Credit Union may assign or delegate its rights or responsibilities to affiliates or contractors.

17. Applicable Law

17.1 These Terms are governed by the laws of the Cayman Islands. Jurisdiction is with the Cayman Islands courts.

18. Notices

18.1 Notices may be sent via Message Center or to the email address on file with the Credit Union.
